TandonHildebrand‘s employment law team is advising the former Chief Operating Officer of Inmind Children’s Services Limited in relation to her whistleblowing claim in the Employment Appeal Tribunal (EAT) following her resignation due to her believing her employer had made her position untenable.
Whistleblowing claims are notoriously difficult to prove and Ms Kashyap has already been successful with the Employment Tribunal (ET) finding that she whistleblew on a number of occasions during her employment. Charu Kashyap, an experienced senior executive with extensive experience in the management of children’s social care and special education for the most vulnerable children in the UK, is now appealing to the EAT. The appeal includes grounds that the ET incorrectly considered the detriments suffered, made unsustainable findings and was mistaken in its overall approach to causation and the burden of proof. Ms Kashyap’s position became untenable because she whistleblew.
